Andrew Sclar, Joseph J. (J.J.) Minioza, Douglas (Gregory) Kilduff and David Frankenberger have been selected for the 2016 Northern California Super Lawyer list. This is the third year Mr. Sclar has been named a Super Lawyer. He is the Managing Partner of the firmís San Francisco office and serves as a member of Ericksen Arbuthnot's Board of Directors.
Mr. Sclar is also Co-Chair of Ericksen Arbuthnot's Insurance Coverage practice group. He advises clients by issuing coverage opinions on a wide range of insurance issues arising under a variety of insurance policies, including general liability, property, errors and omissions, standard form, manuscript, primary and excess. Mr. Sclar also represents clients in insurance coverage litigation, including declaratory relief actions, defense of extra contractual liability claims, insurance policy rescission actions and subrogation and contribution actions under additional insured endorsements.
Mr. Sclar also specializes in defending professional liability claims, including claims against lawyers, real estate agents and insurance agents and brokers. He has a broad range of additional experience handling construction defect and construction site accident cases, as well as wrongful termination, premises liability, products liability, commercial and residential landlord-tenant matters, and commercial trucking cases. He has been with Ericksen Arbuthnot since 1985, has successfully tried cases in many Bay Area courts and has a strong track record in representing clients in state and federal appeals.
This is the fourth year Mr. Minioza has been acknowledged as a Super Lawyer. He is also AV® Peer Review Rated Preeminent by Martindale Hubbell. He is the Assistant Managing Partner of the Oakland/East Bay office and Co-Chair of the firm's Employment Law Practice Group and the Real Estate Practice Group.
Mr. Minioza is a trial attorney specializing in defending companies and insurance carriers in many types of civil litigation, including employment, real estate and construction, personal injury, and commercial disputes. He has tried numerous cases to verdicts with a high degree of success in state and federal court in the San Francisco Bay Area. He also has extensive experience in arbitrating and mediating complex claims and suits.
Mr. Kilduff is the President of the firm and a member of its Board of Directors. He is also the managing partner of the Sacramento office. He is AV® Peer Review Rated by Martindale Hubbell. He is the Co-Chair of the firmís Personal Injury practice group, where his practice includes defending construction site injury, motor vehicle, commercial trucking and auto cases, premises liability and products liability cases.
Within his diverse litigation practice, Mr. Kilduff has also defended medical professionals, medical facilities and elder abuse cases. In addition, he has real estate litigation experience defending the interests of real estate professionals, such as home inspectors. He has trial experience in state and federal courts.
Mr. Frankenberger is AV® Peer Review Rated by Martindale Hubbell. Mr Frankenberger's practice includes complex state court and federal court litigation involving professional liability/errors and omissions defense; MVA accident defense; trucking defense; personal injury; premises liability; product liability, and construction defect liability for both subcontractors and developers. In addition he defends healthcare matters, including claims against doctors, nurses, chiropractors and dentists. His products liability experience includes cases for manufacturers, distributors and retailers. Over the course of his career, Dave has successfully tried numerous matters to jury verdict, including jury trials in both state and federal court, including six jury trials to verdict in the past three years.
Mr. Frankenberger has also written articles on Construction Risk Management/Dispute Avoidance and one for the Defense Research Institute's publication Defense Ethics and Professionalism, titled “Prevent Costly Misunderstandings: Non-Engagement Letters.” He has given a number of presentations, including at MC2's Annual West Region Construction Defect & Insurance Coverage Conference in San Diego, California in 2013 and 2015 and the Annual West Coast Casualty Conference in Anaheim, California in 2014.
